These Terms of Service ("Terms") govern your use of the Psalmist mobile application ("the App") and the website at psalmist.technologyforprogress.com ("the Website"), provided by Technology for Progress ("we," "our," or "us"). By using Psalmist, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using the Psalmist app, or by accessing the Psalmist website and its tools, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.
2. Description of Service
Psalmist provides:
- iOS/iPadOS App: A chord chart management application for organizing, transposing, and performing songs.
- Chord Chart Converter (Website): An AI-powered tool that converts chord chart files (PDF, DOCX, TXT, DOC) into JSON format compatible with the Psalmist app.
- Chord Chart Viewer (Website): A free tool for previewing JSON chord chart files in a browser.
3. Content Licensing and Copyright
Important: Psalmist is a tool for managing chord charts. We are not responsible for the licensing of any lyrics, chord sheets, or other copyrighted material you import into, create within, or convert using our services.
3.1 Your Responsibility
You are solely responsible for ensuring that you have the appropriate rights, licenses, or permissions to use, reproduce, and display any content you manage through Psalmist. This includes but is not limited to:
- Song lyrics and musical compositions
- Chord charts and lead sheets
- Files uploaded for AI conversion
3.2 CCLI and Other Licenses
If you use copyrighted worship music, we strongly recommend obtaining appropriate licenses such as a CCLI license. Psalmist does not provide, manage, or verify any copyright licenses on your behalf.
3.3 Your Content
You retain all rights to the content you create, import, or convert using Psalmist. We do not claim ownership of your songs, setlists, or chord charts. Content stored in the app remains on your device and/or your personal iCloud account.
4. Chord Chart Converter — Paid Service
4.1 Pricing and Credits
- The Chord Chart Converter requires conversion credits to process files.
- Credits are sold in batches of 10 for $2.99 USD (or equivalent in your local currency).
- Each credit allows conversion of one file. Multi-song DOCX files count as one credit regardless of the number of songs contained.
- Credits do not expire.
4.2 Payment Processing
All payments are processed by Stripe. By making a purchase, you also agree to Stripe's Terms of Service. We do not store your payment information.
4.3 Refunds
Because conversion credits are consumed immediately upon use, refunds are handled on a case-by-case basis. If a conversion produces unusable results due to a service error, please contact us at [email protected], and we will either issue a refund or provide replacement credits.
4.4 Conversion Quality
The Chord Chart Converter uses AI to interpret and convert chord chart files. While we strive for high accuracy, results may vary based on the formatting and quality of your source files. We recommend reviewing converted files in the Chord Chart Viewer before importing them into the app.
5. Acceptable Use
You agree not to:
- Use Psalmist for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the app
- Exploit the Chord Chart Converter service to process content unrelated to chord charts or music
- Attempt to circumvent the credit system or payment requirements
- Share or distribute your session tokens with others
- Use automated tools to submit bulk conversion requests beyond normal usage
6. Intellectual Property
Psalmist, its logo, design, and code are the intellectual property of Technology for Progress. The JSON chord chart format, conversion prompts, and rendering engine are proprietary. You may not copy, modify, or distribute the app or website code without our written permission.
7. Disclaimer of Warranties
Psalmist is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be uninterrupted, timely, secure, or error-free
- AI-powered conversions will be 100% accurate
- The app will be compatible with all devices or operating system versions
- Any errors in the service will be corrected
8. Limitation of Liability
To the maximum extent permitted by applicable law, Technology for Progress shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use Psalmist
- Any unauthorized access to or use of our servers or any personal information stored therein
- Any errors, inaccuracies, or omissions in AI-converted chord charts
- Any content or conduct of any third party on our services
- Loss of copyrighted material or licensing violations arising from your use of the service
9. Indemnification
You agree to indemnify and hold harmless Technology for Progress, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of Psalmist, your violation of these Terms, or your violation of any rights of a third party, including intellectual property rights.
10. App Store Terms
If you download the Psalmist app from Apple's App Store, you also agree to Apple's Licensed Application End User License Agreement (Standard EULA). In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail with respect to the app distribution.
11. Termination
We may terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service ceases immediately. Unused conversion credits may be forfeited upon termination for cause.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of Psalmist after any changes constitutes acceptance of the new Terms. Material changes will be communicated through the app or website.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
